1. COMPANY & OWNERSHIP
Sevenfires AI LLC, located in Wisconsin, United States, is the parent company and owner of the VivaLingua mobile application and the website at vivalingua.app (collectively, the "Service"). References to "we," "us," or "our" in these Terms refer to Sevenfires AI LLC.
2. AGREEMENT TO TERMS
By accessing or using VivaLingua, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.
3. ELIGIBILITY
You must be at least 18 years of age to use this Service. By using VivaLingua, you represent and warrant that you meet this requirement.
4. ACCOUNT REGISTRATION
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use.
5. SUBSCRIPTION PLANS & PAYMENTS
VivaLingua is offered on a freemium subscription basis. A Free plan provides limited daily call-hosting minutes at no cost. Paid plans (including Pro, In-Person, and Pro+) are billed monthly or annually through Stripe and unlock additional features such as unlimited call hosting, in-person translation sessions, and additional language pairs, as described on the in-app pricing screen. Guests joining a call or session hosted by another user are never charged. Subscriptions renew automatically until cancelled and are subject to Stripe's terms of service. You may change or cancel your plan at any time in the app; cancellations take effect at the end of the current billing period. Amounts already paid are non-refundable except where required by law.
6. ACCEPTABLE USE POLICY
You agree not to use this Service for any illegal activity, harassment, fraud, or to transmit harmful or offensive content. Violations may result in immediate account termination without refund.
7. VOICE TRANSLATION & CONTENT
VivaLingua provides real-time AI voice translation. We do not guarantee 100% accuracy of translations. You are responsible for verifying important communications independently.
8. CALL & SESSION RECORDING CONSENT
You are responsible for obtaining consent from other participants before recording any call or in-person session in jurisdictions where such consent is required. You agree not to attempt to circumvent any security or privacy protections we may put in place.
9. PRIVACY & DATA
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. LIMITATION OF LIABILITY
Sevenfires AI LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the past 12 months.
11. THIRD-PARTY SERVICES
The Service uses Stripe for payments, Daily.co for video calling, and Resend for transactional email. Use of these services is subject to their respective terms and privacy policies.
12. INTELLECTUAL PROPERTY
All content, features, and functionality of VivaLingua are owned by Sevenfires AI LLC and protected by applicable intellectual property laws.
13. TERMINATION
We reserve the right to suspend or terminate your account at any time for violations of these Terms, with or without notice.
14. GOVERNING LAW
These Terms shall be governed by the laws of the State of Wisconsin, United States, without regard to conflict of law provisions.
